1. About Us

Travelisa is a private company with legal address at Paris (75008), France, 21/25 rue Balzac, and Registration Number SIRET 425 413 270 00914 — RCS Paris, (hereunder referred to as “Travelisa”, “we”, “us”, “our”). We offer travel-related services to travellers (referred hereunder as the “Services”).

2. Scope of application of these terms and conditions

These terms and conditions are applicable to any and all Services offered by Travelisa on its website to users (hereunder referred to as “Customer”, “User”, or “You”, “Your”) wishing to seeking support with the visa application process, specifically:

• Document validation and verification via our partner Nuron.Ai
• Guidance on document preparation and submission requirements by several channels
• Assistance with completing visa application forms
• Document review and optimization
• Delivery of a final visa application package
• Creation of an account and email address on your behalf on the Government website and upload of the visa form when applicable.

You hereby accept and confirm that, prior to create your account, You have read, understood and agreed to be bound by, without limitation or qualification, these terms and conditions.

Save for clear proof to the contrary, the data recorded in the Travelisa information system shall constitute proof of all transactions the Customer has entered into with Travelisa.

Our Services are consultative in nature and do not guarantee visa approval, which remains the competence and powers of immigration authorities. You hereby acknowledge and agree that no claims regarding the decisions made about your visa application or its consequences shall be addressed to Travelisa.

As a result, Travelisa accepts no liability howsoever arising regarding the decisions made by the authorities with respect to your visa application and regarding any delay by the authorities in the assessing, granting or rejecting Your visa application or for the requesting of further information with respect to the visa application.

Should any of the provisions of these conditions be declared null or without effect, this provision should be interpreted in such a way as to reflect as far as possible the intentions of the parties and the remaining provisions will be considered as automatically applicable.

3. Services order

To order any Service to be provided by Travelisa, You are required to complete the following actions via the Travelisa website:

• register on Travelisa website and create an account,
• chose the Service you want to buy and pay for this Service,
• upload the documents asked,
• fill in the online application form where applicable,
• Send more information or correct wrong information where applicable,
• Change your password to access to your account on the Government website,
• download the final application package.

When using our services, You must:

• Provide true, accurate, and complete information
• Ensure you have the appropriate legal rights or obtained appropriate consent to share personal data of third parties with Us
• Submit authentic and unaltered documentation
• Authorize Travelisa to create on your behalf an account on the Government website and to complete and upload the visa application form, which will be available in your account for the next steps of Your process (unless You have expressly opted-out of that part of the Service)
• Use our services only for lawful purposes and in the conditions defined in these terms and conditions of use
• Communicate respectfully with our staff
• Understand and accept that Travelisa S.A. does not guarantee visa approval

Travelisa will only accept a booking and order of the Services if You have previously confirmed, in such manner as Travelisa may determine, to abide by these terms and conditions whilst registering. Such confirmation constitutes the proof of the contract for provision of Services to You. A booking of Services shall not be deemed final until Travelisa has acknowledged acceptance of the order and has received full payment of the price of the Services.

4. Provision of Services

Travelisa undertakes to use its reasonable endeavours, care and skills, to provide the Services to Customers.

You are responsible for ensuring that all information and documentation You provide is accurate, true, up to date and legally transferable.

Timeframes are estimates only and cannot be guaranteed.

5. Service Fees

Fees stated are only valid on the day that such fees are quoted. For Services on a later date, the fees may be subject to a change.

The Service fees collected by Travelisa are fixed in Euros but payable in the currency of the country where the Customer is located.

Service fees are inclusive of value-added tax and displayed on Travelisa website.

All fees must be received in full under the available payment options as cleared funds for the Services to be processed. Fees are non-refundable and non-transferable once the Service is completed, even partially, or whether or not You decide to withdraw Your visa application.

If You prefer opt-out the creation by Us on Your behalf of Your account on the Government website and upload of the visa application form, You will not receive any discount.

Travelisa reserves the right to amend the Service Fees and to charge such amended Service Fees to Customer after the effective date of such amendment. You shall take into account this fact in case You plan to make an order on a future date. Travelisa shall issue Customer with a digital receipt upon payment of the Service Fee.

Travelisa reserves the right to cancel or refuse any Service order if there is an existing dispute with the Customer regarding the payment for previous Service orders.

6. Payment Terms

The Service Fees are payable in full before execution of the Service, through the following methods :

• by credit/debit card and for distant payments (online, phone, etc.) by a secure payment method;
• by any other means of payment accepted by Travelisa after these terms and conditions came into force.

Travelisa will issue the Customer with a digital receipt for the transaction upon receiving cleared payment of the Service Fees.

Customer is liable for any charges and interest her or she may incur by using the available payment method.

Payment data is encrypted before transfer using high secured protocol.

Payment is required before document processing begins. Travelisa shall not be required to provide any Services if the Service Fees have not been paid in full.

7. Cancellation Conditions

It is important that You read this section carefully.

As digital services, our Services are made available immediately after the validation of your payment. It means that You understand, acknowledge and consent to not benefit from a cool-off period to cancel the Service.

You may not change your mind for any Service once the Service has been availed (even if not fully completed).

Travelisa shall not refund any payments of a Service Fee made on grounds that the Customer has not been granted a visa or because of delays in the visa application.

8. Dispute Resolution Process

If You have concerns about our Services, contact our Customer Service Department via the contact form available on our website during business hours (Monday-Friday, 9:00-18:00 CET). We'll reply to you within 7 business days.

If we cannot resolve your dispute through the Customer Service, any unresolved dispute may be raised within one (1) year from Your request. You agree to resolve disputes on an individual basis only.

9. Applicable laws - Legal Jurisdiction

These Terms and conditions are governed by French law. You accept that any disputes that is not resolved by the dispute resolution process above shall be subject to the jurisdiction of the competent court of Paris, France. The English version of these Terms prevails over any translations.

10. Intellectual Property

Travelisa website content is the intellectual property of Travelisa group and is protected by applicable intellectual property and antitrust laws.

Copying or placement of the information in whole or in part on other websites without the link to the Travelisa website is strictly forbidden and constitutes an act of infringement.

Furthermore, Travelisa shall retain all intellectual property rights in the photographs, presentations, studies, designs, models, prototypes, etc. created (including at the Customer’s request) for the purposes of providing the Services. The Customer therefore agrees not to reproduce or to use said studies, designs, models, prototypes, etc. without the express prior written authorization of Travelisa, for which Travelisa shall be entitled to request financial compensation.

11. Responsibility

Travelisa accepts no liability for any special, indirect, punitive or consequential damages resulting from use of our Services. We provide our Services "as is" without warranties of any kind.

The diplomatic missions give no competence and powers whatsoever to Travelisa regarding the assessment of visa applications or decision-making regarding visa applications. As a result, Travelisa accepts no liability howsoever arising regarding the decisions made by the diplomatic missions with respect to your visa application or regarding any delay by the diplomatic missions in the assessing of your visa application or for the request of further information on your visa application.

Travelisa accepts no liability for loss, delays or non-issuance of any visa or visa application arising from or in connection with (such as but not limited to) incomplete application forms, incorrectly or falsely completed application forms, and inaccurate, incomplete or false information or supporting documentation, or any advice or information given in relation to any application.

Travelisa accepts no liability howsoever arising for any delay or failure in the provision of the Services caused by a third party or resulting from circumstances beyond reasonable control of Travelisa, including natural disasters, pandemics, governmental actions, and cyber-attacks.

12. Partners

Travelisa may allow partners to advertise on its site and/or connect You with partners. Travelisa does not endorse these partners and assumes no responsibility for these third-party sites or the products and services provided by these partners. Travelisa does not act as an agent or representative of these partners.

13. Data Protection

We process personal data in accordance with our Privacy Policy and applicable data protection laws, including GDPR. Your use of our services constitutes consent to the collection and processing of your personal information as described in our Privacy Policy published on Travelisa website. We may use subcontractor(s) as described in this Privacy Policy.

14. Changes to Terms

These terms and conditions may be accessed and viewed on the Travelisa website at any time. All changes, amendments, amplifications or withdrawals to or of these terms and conditions from time to time, shall be published on the Travelisa website. These amended terms and conditions, as displayed on the Travelisa website, shall prevail over any previous version of these terms and conditions or over any other conflicting documents.

We reserve the right to modify these Terms at any time.
